The petitioner seeks bail in connection with a case registered for the offence punishable u/s 30(a), (c) of Bihar Prohibition and Excise (Amendment) Act, 2018. 3.

Altogether, 50 litres of Jawa Mahua, 25 litres of country made liquor and other articles is said to have been recovered from the spot.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has been implicated in this case due to ulterior motive. It is submitted that the recovery was made from open place and the same does not belongs to the petitioner. It is further submitted that the petitioner has no knowledge about illicit liquor which was kept at the place of

Patna High Court CR. MISC. No.71896 of 2025(2) dt.09-10-2025 2/2 recovery. Petitioner has no concern with the seized articles or with the manufacturing of illicit liquor. The petitioner has no criminal antecedent and has been languishing in custody since 25.08.2025.

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-II, Aurangabad, in connection with Daudnagar Excise P.S.
