Mr. Abhay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2020 The petitioner seeks bail in connection with Rajoun P.S. Case No. 273 of 2019 dated 24.06.2019 instituted for the offence under Section 392 of the Indian Penal Code.
The petitioner has not been named in the FIR but later, an onlooker/pedestrian claims to have identified the petitioner moving on a motorcycle. On the basis of the aforesaid statement of Sajan Kumar referred to above, the petitioner was arrested and was made to record his confession.
Apart from the aforesaid confession and taking of his name by a pedestrian, there is no other material available in the entire investigation report to connect the petitioner with the crime.
Nothing has been recovered from the
Patna High Court CR. MISC. No.64880 of 2019(3) dt.04-03-2020 2/2 possession of the petitioner nor has he yet been put on test identification parade.
Considering the aforestated facts and taking into account the period of custody of the petitioner which is from 29.06.2019, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 273 of 2019.
Before saying so, this Court has also perused the antecedent of the petitioner. He has been made accused in three cases but in all such cases he is on bail. (Ashutosh Kumar, J) krishna/- U T
