The petitioner is in custody in a case registered for the offence punishable under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

As per allegation in the FIR, total 386 liters of country made Mahua liquor was recovered.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He next submits that on the basis of secret information, the name of the petitioner figured in this case and the aforesaid liquor has been recovered from a bush and not from the possession of the

Patna High Court CR. MISC. No.73191 of 2025(2) dt.15-10-2025 2/2 petitioner. Petitioner is in custody since 12.09.2025. Learned APP for the State opposes the prayer for bail of this petitioner.

In view of the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna City, Patna in connection with Malsalami P.S. Case No. 261 of 2017.
