2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 302,120B/34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and other accused persons, by hiring criminals, killed son of the informant in a planned conspiracy.

4.Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of suspicion because of land dispute between the parties. Besides this, petitioner is not the assailant of the deceased rather he can be alleged to be one of the conspirators of the offence. Co-accused, with similar allegation, have already been allowed pre-arrest bail by a co-ordinate bench of this Court

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Saran at Chapra in Rivilganj Police Station Case No. 419 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
