JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 This modification application has been filed for modification of order dated 19.08.2019 passed in Criminal Misc. No.51617 of 2019 by which the petitioner has been granted the privilege of anticipatory bail to surrender before the learned court below on 28.08.2019.

Submission of learned counsel for the petitioner is that petitioner is a lady and at the relevant time she was pregnant but this fact could not have mentioned earlier and due to which the petitioner could not surrender in time. Heard learned A.P.P. also.

In view of the above facts, I am not inclined to interfere with the order dated 19.08.2019 passed in Criminal Misc. No.51617 of 2019, however, if the petitioner surrenders in

Patna High Court CR. MISC. No.70560 of 2019(2) dt.06-11-2019 2/2 the Court below and make prayer for regular bail, the Court below while passing the order shall consider this aspect of the matter also.

Accordingly, this modification application is disposed of.
