1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners apprehend their arrest in connection with Wazirganj P.S. Case no.401 of 2024 registered under Sections 304B and 34 of the Indian Penal Code.
3. The allegation in the F.I.R is that of causing death of informant's daughter on account of non-fulfillment of demand of dowry by the accused persons including the

It is submitted by learned counsel for the petitioners that the petitioner no. 1 is the father-in-law, petitioner no.2 is the mother-in-law, petitioner nos.3 and 4 are the brothers-in-law and petitioner nos. 5 and 6 are the sisters-in-law (gotni) of the deceased. There is general and omnibus allegation leveled against them in the F.I.R with regard to demand of dowry. The petitioners are not involved in day to day affairs of the deceased and her husband as the petitioners are staying separate in both residence and mess from the deceased and her husband. A supplementary affidavit has been filed on behalf of petitioners to bring on record the fact that husband of the deceased who is primarily responsible for welfare of his wife has surrendered on 10.07.2025 before the learned A.C.J.
M-1st, Gaya and the surrender receipt has also been brought on record by way of Annexure-1 to the said affidavit. He further submits that independent witnesses who have been examined during course of investigation have all supported the fact that on the date of occurrence, the deceased was all alone and had committed suicide by hanging from fan which finds support in paragraph nos. 38 to 42 of the case diary. The petitioners have no criminal antecedent and undertakes to co-operate in investigation/trial.

5. The application for bail is opposed by learned APP for the State.
6. Considering the aforesaid facts and circumstances of the case and also considering the fact that the husband of the deceased is in judicial custody, it is directed that the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Wazirganj P.S. Case no.401 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
