1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 329(4), 117, 109 and 3(5) of the BNS.

Learned counsel for the petitioners submits that petitioner no. 1 has two antecedents and rest of the petitioners are persons with clean antecedent and the informant alleges that on 08.07.2025, at 05:00 p.m., Chintu Kumar (petitioner no. 3), Lalit Singh (petitioner no. 2) and Basant Singh (petitioner no. 5)

Patna High Court CR. MISC. No.72174 of 2025(2) dt.11-11-2025 2/3 came and started abusing. On protest, they started assaulting them. Further, Sanjay Chandravanshi (petitioner no. 1) and Sumit Kumar (petitioner no. 4) came with rod and thereafter all the accused indiscriminately assaulted by rod causing injury on head of Shatrudhan Singh while Vindhyachal Singh suffered fracture of hand on account of assault by lathi. Further, Manish Singh, Niraj Singh and Badan Singh suffered injury on their body on account of assault by lathi and the accused also assaulted Kalawati Devi.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that petitioners and the informant are neighbour and they are having dispute relating to passage on which an altercation took place in which both sides assaulted each other. It is next submitted that allegation of assault is not specific and the injury suffered by the injured has been opined to be simple in nature.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial

No.72174 of 2025(2) dt.11-11-2025 3/3 court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Kutumba P.S. Case No. 98 of 2025 corresponding to G.R. No. 2115 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
