2. The petitioner is apprehending his arrest in a case registered for the offences under Sections 274, 275 of the B.N.S. and 30(a) of the Bihar Prohibition and Excise Act.

3. As per the FIR, the police received secret information that the accused persons had brought illegal liquor for sale and stored it at the house of Amunullah. On reaching the spot, the accused persons tried to flee, but the police apprehended Rubina Khatoon and Amunullah, while others escaped. Upon search, 89.100 liters of Nepali liquor was recovered from the house.

4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has been falsely implicated in the instant case only on the instance of persons inimical to him. There is no recovery from the possession of the petitioner. It is

He is not indulged in the business of illegal liquor. Lastly, it is submitted that the petitioner has no criminal antecedent.

5. Learned APP for the State vehemently opposes the prayer for grant of anticipatory bail.

6. Considering the facts and circumstances of the case, since there is no recovery from the possession of the petitioner, let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the Court below within a period of four weeks from today on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge, Court No.3, East Champaran, Motihari in connection with Patahi P.S. Case No.364 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS, 2023.
