The petitioner seeks pre-arrest bail in connection with Basopatti P.S. Case No.83 of 2016 registered under Sections 452 and 354B/34 of the Indian Penal Code.
Having regard to the nature of allegation made in the FIR wherein the informant has alleged that the petitioner along with co-accused Umesh Mandal entered into the house of the informant to outrage her modesty, I am not inclined to grant prearrest bail to the petitioner. Accordingly, the application for grant of pre-arrest bail is rejected.
In case the petitioner surrenders and seeks bail, the same
Patna High Court Cr.Misc. No.1423 of 2018 (2) dt.19-01-2018 2/2 shall be considered on its own merits without being prejudiced in any manner by this order.
