====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-10-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in case registered for the offences punishable under Sections 191(2), 191(3), 190, 115(2), 109, 132, 303(2), 75, 352 of the Bharatiya Nyaya Sanhita.
3. As per F.I.R., these petitioners assaulted informant, who is head master, by means of lathi, danda, iron rod as a result of which he sustained injury.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.71541 of 2025(2) dt.13-10-2025 2/2 petitioners are innocent and have committed no offence. Allegation against petitioners is general and omnibus and there is no specific accusation of overt act against these petitioners.
5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that there is direct and specific accusation that these petitioners along with other accused persons assaulted informant as a result of which he sustained injury.
6. Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is refused.
