JUSTICE ARUN KUMAR ORAL ORDER 15-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Ghoghardiha PS Case No. 117 of 2017 registered under Sections 379 and 414/34 of the IPC.

It is submitted that one of the so called seized motorcycle was given by the father-in-law of the petitioner and the certificate of registration of the said motorcycle stands in his name, seizure is also doubtful because copy of the seizure list was not given to the petitioner or any family members, similarly situated another coaccused Prem Lal was granted bail by a coordinate Bench of this Court and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Md. Basir is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Jhanjharpur in connection with Ghoghardiha PS Case No. 117 of 2017.
