2. The petitioner seeks bail in connection with Karjain P.S. Case No. 10 of 2024 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 332, 333, 353, 427, 504, 506 of the Indian Penal Code.

3. As per prosecution case, when the police party went to arrest the petitioner at his house in connection with Karjain P.S. Case No. 170 of 2023, the petitioner attempted to flee away unsuccessfully but, was apprehended with a loaded pistol in his possession. In the meantime, the family member of the petitioner attacked the police and obstructed their official duty. During altercation, three police officials sustained head injuries

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case with false and frivolous allegations. The petitioner has not committed any offence as alleged in the F.I.R. Though one loaded pistol was alleged to be recovered from the possession of the petitioner but, neither seizure list was prepared nor provision of Arms Act was added in the F.I.R. but, a separate case bearing Karjain P.S. Case No. 09 of 2024 was registered under the Arms Act. Learned counsel for the petitioner submits that there is no direct or specific allegation of any overt act against the petitioner rather the same is general and omnibus in nature. The petitioner has altogether five criminal antecedents and, in all of them, he is on bail and is languishing in judicial custody since 25.01.2024 without any rhymes or reason.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged against the petitioner is serious in nature. The injury report supports the prosecution case. The police has also recovered one country made pistol from the possession of the petitioner. The petitioner has five criminal

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Karjain P.S. Case No. 10 of 2024. (Rudra Prakash Mishra, J) rishi/- U T
