2. The petitioners has prayed for regular bail in a case registered for the offence punishable under section 30 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. The case of the prosecution is that altogether 342.72 liters of country made liquor was recovered from a Pick up Van.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that these two petitioners were carrying the consignment at the

Patna High Court CR. MISC. No.71987 of 2025(2) dt.09-10-2025 2/2 instance of one Monu Kumar. It is further submitted that nothing has been recovered from the conscious possession of the petitioners. It is also submitted that the petitioners are owner of the seized vehicle and they had no knowledge about the alleged illicit liquor. Moreover, the petitioners are languishing in judicial custody since 08.08.2025 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Sahar P.S. Case No. 156 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. II, Bhojpur at Ara.
