The petitioner is apprehending arrest in connection with Wazirganj P.S. Case No. 108 of 2018 for the offence under Sections 304 read with Section 34 of the Indian Penal Code. Learned counsel for the petitioner submits that all the three petitioners are doctors and practicing in Janta Nursing Home where pregnant lady was treated and after birth of female child when doctors realized the condition of both child and mother are critical, the petitioner no.1, suggested that patient may be taken for treatment at Gaya.

The whole allegation appears against the petitioners is

Patna High Court Cr.Misc. No.38196 of 2018(3) dt.10-12-2018 2/2 negligence on the part of the doctors in the treatment. Considering the fact that petitioners have no criminal antecedent and allegation against them that they have committed negligence in treatment. Let the petitioners above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Gaya in connection with Wazirganj P.S. Case No. 108 of 2018.
