The present application has been filed for modification of order dated 15.05.2019 passed in Cr. Misc. No. 15398 of 2019 to the extent of extending the period of surrender.

Learned counsel for the petitioner confines his prayer only to the extent of extending the period of surrender since the petitioner resides abroad, whereas it is submitted by learned counsel for opposite party no. 2 that the petitioner deliberately has not surrendered within stipulated period.

No.67736 of 2019(2) dt.06-11-2019 2/2 In the circumstances, keeping in view the nature of accusation and the stand of the petitioner, the period of surrender is extended by three weeks from the date receipt/production of a copy of this order and the period of provisional anticipatory bail is extended by 20th of February, 2020 in connection with Complaint Case No. 44 of 2018, pending in the Court of learned Sub-divisional Judicial Magistrate, Samastipur. However, the petitioner must shows his bonafide during the present period to contact with the complainant and to get the issue resolved.

The order dated 15.05.2019 is modified to the extent indicated above.

Accordingly, this modification application stands disposed of.
