The petitioners seek Anticipatory bail in connection with Ishuapur P.S. Case No. 127 of 2017 registered under Sections 341, 323, 324, 325, 338, 307 of the Indian Penal Code. Later on added 302 IPC.

It has been submitted on behalf of the petitioners that there is no specific allegation against the petitioners of assaulting the informant (deceased) and allegation against them is of general and omnibus in nature. There is specific allegation is against Ranjit Singh. It has been further submitted that deceased Jaleshwar Singh is own grand father of petitioners. It has been further submitted that petitioners are school going

Patna High Court Cr.Misc. No.47047 of 2018(4) dt.13-09-2018 2/2 students and they are brother and sister. Informant (Deceased) had not given share to the petitioner's father, due to this reason, dispute was going on. Petitioners have no criminal antecedent and the injury sustained by the petitioners is simple in nature. Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioners named above in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran, in connection with Ishuapur P.S. Case No. 127 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
