2. The petitioner seeks bail in a case registered for offence under Section 22(b) of the N.D.P.S. Act, 1985.
3. It is alleged that 1429 bottles of Codeine Phosphate and Triprolidine Hydrochloride wiscof Syrup of 100ml, kept in seven yellow plastic sack, was recovered from a Maruti Car, of which, this petitioner is registered owner.
4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious possession of this petitioner and has been made accused in this case merely because he is owner of the vehicle in question. He further submits that without his knowledge or consent, the vehicle of petitioner was being used for transporting alleged cough syrup. Petitioner has got clean antecedent and is in custody since 09.09.2024. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the period of custody and clean antecedent, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Darbhanga / concerned Court in connection with Suppl. PTN (N.D.P.S.) Case No. 01 of 2023.
