The petitioner seeks bail in connection with S.Tr. No. 191 of 2025, arising out of Runnisaidpur P.S. Case No. 199 of 2024 instituted for the offence under Sections 302 & 34 of the Indian Penal Code and Section 27 of the Arms Act. 3.

The prosecution case, is that, on 11.06.2024 at about 8:30 P.M., accused Kumar Shiv, Vikesh Kumar (petitioner), Dharmendra Kapar, and two others entered the house of informant, demanded a neighbour's daughter's marriage with Shiv's nephew, and on refusal, Kumar Shiv shot fire upon the informant's wife. When villagers arrived, the accused assaulted them and fled while firing in the air.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.01.2025. Petitioner bears one criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. From perusal of the FIR, it would reveal that the only allegation against the petitioner is of order giver. There is no specific allegation against the petitioner, rather the same is general and omnibus in nature. Specific allegation of firing is against co-accused, Kumar Shiv. Police upon completion of investigation has submitted charge sheet in this case. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation against the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with S.Tr. No. 191 of
