The petitioner seeks bail in connection with Jamui P.S. Case No. 125 of 2019, registered under Sections 147, 148, 149, 307 and 302 of Indian Penal Code and Section 27 of the Arms Act, pending in the Court of learned Chief Judicial Magistrate, Jamui.
The accusation is that while informant Manish Kumar was loading paddy straw on tractor, meanwhile, 15 persons named in the F.I.R., including the petitioner, and three unknown came there boarding on three motorcycles having country made pistol and pistol in their hands and started to make firing at his father Gorelal Mahto. It is alleged that Ganga Singh @ Manish Singh, firstly, fired at his father causing back
Patna High Court CR. MISC. No.66496 of 2019(3) dt.18-02-2020 2/2 injury to him. Thereafter, Vinod Singh fired at his forehead, Umashankar Singh (Petitioner) fired at the back of his father and Kamlesh Singh fired in his eye, as a result thereof, father of the informant died on the spot.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that 15 persons named in the F.I.R. made firing, but only four firearm injuries found over the deceased, as detailed in Postmortem report. Further submission is that petitioner has no criminal antecedent and he is in custody since 08.04.2019. Having considered the facts and circumstances of the case and nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer of the petitioner, above named, is rejected.
