The petitioner is in custody since 29.08.2022 in connection with Garkha P.S. Case No. 566 of 2022 registered for the offence punishable under Sections 399/402/414 of the Indian Penal Code and Sections 25(1-b) a/26/35 of the Arms Act.
Considering the nature of allegation levelled against the petitioner and also the fact that he is in custody since 29.08.2022, this application for regular bail is allowed. In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail after framing of charge if the charge in not framed yet or on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two

No.73729 of 2022(2) dt.04-03-2023 2/2 sureties of the like amount each to the satisfaction of learned Learned Judicial Magistrate, 1st Class, Saran at Chapra connection with Garkha P.S. Case No. 566 of 2022. The petitioner would cooperate in the proceeding of the Court below. If the petitioner tries to delay the trial, the Court below is at liberty to pass an appropriate order including the cancellation of bail bonds of the petitioner. The petitioner is directed to appear before the Court below through his lawyer or himself on each date, failing which, his bail bonds shall be cancelled.
