2. The petitioner seeks bail in a case registered for the offences punishable under Sections 310(4), 310(5), 317(5) of B.N.S., 2023 as well as under Sections 25(1-B) a, 26 and 35 of the Arms Act.
3. The prosecution case, in short, is that the police on secret information that the miscreants are gathered and they are planning to commit some offence, raided the place and apprehended two accused persons, namely, Avinash Kumar and Subhash Kumar.
4. Learned counsel for the petitioner has submitted that two persons, namely, Avinash Kumar and Subhash Kumar were apprehended and from their possession certain arms were
Patna High Court CR. MISC. No.71799 of 2025(2) dt.13-10-2025 2/2 recovered. These two persons have disclosed the name of this petitioner. It is further submitted that the petitioner has been framed in this case only on the basis of his criminal antecedents. The petitioner is having four criminal antecedents and he is in custody since 13.06.2025.
5. The learned APP has vehemently opposed the bail application.
6. Considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No.90 of 2025.
