JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 At the very outset learned counsel for the petitioners seeks permission to withdraw this application with respect to petitioner Nos. 2 to 4 stating that they have been arrested during pendency of this application and they have been released on bail by the court below.

Accordingly, this application with respect to petitioner Nos.2 to 4 stands dismissed as withdrawn.

Petitioner No.1 seeks bail in anticipation of his arrest in connection with Balia P. S. Case No. 258 of 2019 registered for the offences under Sections 147, 148, 149, 341, 323, 307,

Patna High Court CR. MISC. No.68595 of 2019(2) dt.25-10-2019 2/2 447, 324 and 379 of the Indian Penal Code.

As per FIR petitioner No.1 is said to have assaulted by rod on the nose of the informant.

Submission of learned counsel for the petitioner is that petitioner is agnate and there is family dispute between them and there is no injury on the nose of informant. Heard learned APP also.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Balia P.S. Case No. 258 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
