1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Amarpur P.S. Case no. 381 of 2022 registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, the informant states that while he was going on his motorcycle he was stopped by the four accused persons who assaulted him and on gunpoint took away Rs. 1000/- in cash, his mobile phone, ATM card etc. and escaped.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. He is in custody since 23.8.2022 and charge has been framed in the learned trial Court. He undertakes to cooperate in the trial.

5. The application for bail is opposed by learned APP for the State who submits that the petitioner was identified by the informant in the T.I.Parade.

6. The petitioner produces before the Court a certified copy of the order dated 11.7.2024 of the learned trial Court in evidence of the fact that charge has been framed against the petitioner in the learned trial Court. The same is taken on record.

7. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, the material that has transpired in course of investigation, the petitioner having remained in custody since 23.8.2022 and charge having been framed in the learned trial Court, the petitioner is directed to be enlarged on bail in connection with Amarpur P.S. Case no. 381 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Banka.
