2. The petitioners are apprehending arrest in connection with Piar P.S. Case No. 117 of 2024 dated 25.06.2024, lodged under Sections 341, 323, 307, 504, 506, 34 of the Indian Penal Code pending before the Court of Judicial Magistrate 1st Class, Muzaffarpur.
3. As per the prosecution, FIR has been lodged against two named accused persons (both the petitioners) against whom there is an allegation that they have attacked the informant by knife and caused injury on his chest and neck.
4. Learned Counsel for the petitioners submits that the
Patna High Court CR. MISC. No.75791 of 2024(2) dt.11-11-2024 2/2 petitioners are innocent and have committed no offence. Counsel submits that it is a family dispute and accused persons are younger son and daughter in law of the informant. Counsel further submits that the informant has two sons and he wants to oust his younger son namely Md. Alam (petitioner) from his house and gift that house to his elder son and it is due to this reason, dispute has arisen. Counsel further submits that the criminal antecedent of the petitioners are clean and the present case has been lodged under emotion.
5. Learned APP for the State opposes the prayer for bail of the petitioners and submits that there is specific allegation against the present petitioners that they have attacked the informant by knife.
6. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for anticipatory bail of the petitioners is hereby rejected. (Dr. Anshuman, J) Divyansh/- U T
