The petitioner apprehends his arrest in connection with Harsidhi P.S. Case No.131 of 2020, registered for the offences punishable under Sections 188, 269, 270, 271, 341, 323, 333, 353, 307, 504, 506 and 34 of the Indian Penal Code, Section 3 of the Epidemic Act as well as under Sections 51/53 of Disaster Management Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. It is submitted that the petitioner has got one criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that no specific overt act is alleged againt the petitioner and similarly situated other co-accused persons have already been enlarged on anticipatory bail by this Court

Patna High Court CR. MISC. No.1583 of 2023(2) dt.08-02-2023 2/2 vide order dated 17.01.2023, passed in Cr. Misc. No.65078 of 2022.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Considering the fact that similarly situated other coaccused persons have been enlarged on anticipatory bail by this Court, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran at Motihari in connection with Harsidhi P.S. Case No.131 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
