JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 2151(C) of 2018, disclosing offences under Sections 498(A) of the Indian Penal Code and Section 4 of Dowry Prohibition Act.
Petitioners happen to be father in law and mother in law and allegation against them is of subjecting the complainant to torture with respect to demand of dowry of Rs. Twelve Lakh and also of assault to the complainant.
Submission of learned counsel for the petitioners is that the girl has already filed a divorce case against her husband
Patna High Court CR. MISC. No.70054 of 2019(2) dt.15-11-2019 2/2 and petitioners being father in law and mother in law of the informant, has falsely been roped in the present case and no specific allegation has been attributed to them and they are ready to abide by any condition imposed on them. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Patna, in connection with Complaint Case No. 2151(C) of 2018, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
