The petitioner seeks anticipatory bail in connection with Pirpainty PS case no. 30 of 2017 registered for the offences punishable under Sections 364, 302, 201 and 120B of the Indian Penal Code.
The allegation of the prosecution is that the accused persons had assaulted the husband of the informant, resulting in his death. The learned counsel for the petitioner submits that the petitioner herein has not been named in the FIR and he is having a clean antecedent. It is further submitted that the present case is a case of circumstantial evidence and no evidence has come to fore that the petitioner was last seen with the victim. No.1309 of 2018 (3) dt.12-02-2018 2/2 case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XI, Bhagalpur in connection with Pirpainty PS case no. 30 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
