The petitioner seeks bail in connection with Bahera P.S. Case No.380 of 2023 registered for the offence under Section 30(a) of the Bihar Prohibition & Excise Act. 3.

The recovery is of 315 liters of foreign liquor. The name of the petitioner has come in the confessional statement of co-accused.

Learned counsel for the petitioner submits that the petitioner is in custody since 28.09.2023 and he has clean antecedent. He further submits that petitioner is ready to donate Rs.25,000/- (Rupees Twenty Five Thousand Only) in some charitable organization without accepting his guilt. 5.

Considering the facts and circumstances of

Patna High Court CR. MISC. No.74433 of 2023(2) dt.29-11-2023 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge-II (Excise Act), Darbhanga, in connection with Bahera P.S. Case No. 380 of 2023. 6.

This is also subject to the condition that the petitioner shall deposit an amount of Rs.25,000/- (Rupees Twenty Five Thousand Only) in Ramkrishna Mission Ashrama, Muzaffarpur and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.

The petitioner shall mark his presence in Manigachi Police Station, Darbhanga on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
