The petitioner is apprehending his arrest in connection with Bodh Gaya P.S. Case No. 99 of 2015 for the offence registered under Sections 18, 20, 22, 25A, 27A, 29 of the N.D.P.S. Act.

The allegation against the petitioner is that four persons who were apprehended along with narcotic substance have taken the name of this petitioner. It is further submitted that the said four persons, who were so apprehended from the place of occurrence along with the alleged narcotic substance, have since been acquitted of their charge. The name of the petitioner has surfaced only on the confessional statement made before the police by such apprehended persons. There is no recovery from the possession of the petitioner nor the petitioner

Diary of the present case was called for which has since been received.

Learned counsel for the State, after perusal of the case diary, submits that save and except the allegation made by the co-accused persons, there is no further material in the case diary to implicate the petitioner in connection with the present case. Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest/surrender before the learned counsel below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sessions Judge-cum-Special Judge, N.D.P.S. Act, Gaya in connection with Bodh Gaya P.S. Case No. 99 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
