Petitioner apprehends his arrest in connection with Bahadurganj P.S.Case No. 223 of 2015 registered for the offences punishable under Sections 363, 366, 370, 372, 376, 506/34 of the Indian Penal Code and Sections 5/9 of Immoral Traffic Act. Allegation against the petitioner is that on the pretext of getting married of daughter of informant he had taken away the girl.

Submission of learned counsel for the petitioner is that the allegation is general in nature and her statement under Section 164 Cr.P.C. shows that she wants to marry with one Azmal and he has falsely been implicated in this case. Heard learned APP and perused the statement under

Patna High Court Cr.Misc. No.43053 of 2018 (5) dt.17-09-2018 2/2 Section 164 Cr.P.C. of the victim girl from which it appears that this petitioner has taken her to Bangalore and sold her and he used to torture her and due to which she fled away from that place. Having heard both sides and in view of allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, this application is dismissed.
