2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 ( 2 ), 74, 303 ( 2 ), 308 ( 4 ), 352, 351 (3) , 329 ( 4 ) and 3 (5) of BNS. 3 . The prosecution case in brief, is that on 26.03.2025 , all the F.I.R. named accused persons along with 5 to 6 unknown persons misbehaved with informant. Upon protest, accused persons tore cloth of informant and snatched gold chain from informant.
4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence as alleged. Petitioner is headmaster in a Govt. School namely, Gautam
Patna High Court CR. MISC. No.72699 of 2025(2) dt.01-11-2025 2/2 Middle School, New Dalian Dehari, Rohtas and on the date of alleged occurrence , he was simply discharging his duty and has got no concern with the aforesaid occurrence . Allegation is general and omnibus. Rest of the allegations are ornamental in nature to make the case grave . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ - VII, cum- Special Court (POCSO ) , Sasaram ( Rohtas ) in connection with Dalmiyanagar P.S. Case No. 68 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
