2. The petitioner seeks bail in a case registered for the offences punishable under Sections 316(2), 318(4), 318(2), 318(3), 319(2), 322, 329(3), 336(2), 336(3), 336(4), 338, 340(1), 340(2), 351(2), 351(3) and 61 of B.N.S., 2023.
3. The case of the prosecution, in short, is that there is land dispute between two brothers. The petitioner is the care taker of the land he has been implicated in this case only on that basis and from perusal of the FIR, it is clear that when the informant went to meet this petitioner, he met the son of this petitioner and on the basis of the conversation with the son of the petitioner, this petitioner has been framed in this case.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.71891 of 2025(2) dt.13-10-2025 2/2 that save and except the statement of the son of the petitioner, there is nothing against him and he has only been given land in lieu of his wages as he is the care taker of the land. It is further submitted that it is a case of land dispute between two brothers and petitioner is merely a care taker of the land. It is also submitted that the petitioner is aged about 70 years having criminal antecedents of two cases. It is lastly submitted that the petitioner is in custody since 26.08.2025.
5. The learned APP has vehemently opposed the bail application.
6. Considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur (Garha O.P.) P.S. Case No.1366 of 2024.
