2. The petitioner seeks bail in a case registered for the offences punishable under Sections 137(2), 140(3) and 3(5) of B.N.S., 2023.

3. The case of the prosecution, in short, is that the petitioner has kidnapped the minor daughter of the informant. During course of investigation, the victim was recovered and she has given her statement under Section 183 of B.N.S.S. wherein she has stated that on 27.05.2025, she went out of the house. She was at Patna. She was living in a hired room and Mukul Kumar was also there. After that she was recovered.

4. Learned counsel for the petitioner has submitted that from perusal of the statement of the victim, which has been

Patna High Court CR. MISC. No.71904 of 2025(2) dt.14-10-2025 2/2 annexed as Annexure-P/2, it is clear that the victim has not named this petitioner rather she has named one Mukul. It is further submitted that there is nothing against this petitioner and from perusal of the statement of the victim recorded under Section 183 of B.N.S.S., it is clear that the victim herself has exonerated the petitioner from the allegations. The petitioner is in custody since 04.06.2025 having no criminal antecedent.

5. Learned APP for the State as well as learned counsel for the informant vehemently opposed the bail application.

6. Considering the above facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, First Class, Dalsinghsarai in connection with Dalsinghsarai P.S. Case No.193 of 2025.
