The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 30(a), 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Altogether 56 litres of illicit country made liquor is said to have been recovered from the motorcycle of the petitioner.

Learned counsel for the petitioner submits that petitioner is quite innocent and has been falsely implicated in this case merely on suspicion. He has no concern with the alleged recovered illicit liquor. No incriminating article has been recovered from the conscious physical possession of the

Patna High Court CR. MISC. No.71965 of 2025(2) dt.09-10-2025 2/2 petitioner. Though it is alleged that the recovery has been made from his motorcycle but the real fact is that the petitioner was going to Naini temple and on the main road corner, his motorcycle slowed down due to traffic and in the meantime another motorcycle crossed him throwing away the bags on side of the road and the excise team caught the petitioner under suspicion. Petitioner is in custody since 22.08.2025. 5.

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.03, Saran at Chapra, in connection with Sadar Excise P.S. Case No. 199 of 2025.
