2. The petitioner seeks regular bail in connection with Kawakole P.S. Case No. 262 of 2025 registered for the offence under Section 87 of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the petitioner is accused of taking away the minor victim girl by alluring her.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 29.07.2025 and claims clean antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.
6. Though the allegation against the petitioner is of
Patna High Court CR. MISC. No.72033 of 2025(3) dt.19-12-2025 2/2 kidnapping the victim girl but from the statement of the victim girl it appears that the victim girl had left her house on her own because of the bad behavior of her father.
7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.
8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Nawada/concerned Court below in connection with Kawakole P.S. Case No. 262 of 2025 subject to condition(s) that:- (i). At the time of accepting the bail bonds of the petitioner, the Court below shall verify the fact whether the petitioner has clean antecedent or not. If it is found that the petitioner has clean antecedent then only his bail bonds shall be accepted by the Court below.
