====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-12-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Suryapura P. S. Case No. 247/2023 in a case registered for the offence punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, three named and several other unknown accused persons committed murder of the husband of informant.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired during course of investigation on confessional statement of coaccused namely Ajit Kumar. He further submits that on the alleged date of occurrence, petitioner was already in police
Patna High Court CR. MISC. No.77965 of 2024(2) dt.20-12-2024 2/2 custody in connection with Jagdishpur P. S. Case No. 353 of 2023 as such, his involvement in the alleged occurrence is highly unimaginable. Except confessional statement, no other material is available on record to show the complicity of petitioner in the alleged occurrence. Petitioner is in custody since 16.12.2023. Chargesheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 13th Additional Sessions Judge, Rohtas at Sasaram in connection with Suryapura P. S. Case No. 247/2023 corresponding to S.T. No. 360 of 2024.
