1. Heard learned counsel for the petitioner and the learned APP for the State.

2. The learned counsel for the petitioner submits that during pendency of the instant anticipatory bail application, the petitioner was given benefit of Section 35 BNSS, as such, for the present, does not have any apprehension of arrest, hence, seeks permission to withdraw the anticipatory bail application with liberty to file afresh, if need arises.

3. Permission is accorded.

4. Accordingly, the instant anticipatory bail application is dismissed as withdrawn with the liberty aforesaid.
