1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 309(4) and 317(2) of the BNS, 2023.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a young boy aged about 22 years and the informant alleges that four unknown accused intercepted him and looted his tractor on point of pistol.

4. Learned counsel for the petitioner submits that FIR was against unknown and the name of the petitioner transpired in the confessional statement of co-accused, namely, Abhishek

It is further submitted that petitioner is a student of Indira Gandhi National Open University and in support of the same, learned counsel appearing on behalf of the petitioner produced the admit card of the petitioner which is taken on record. It is next submitted that in the nature of allegation, if the petitioner is sent to judicial custody his entire career would get jeopardized and chances are bright that he may come in contact with the hardened criminals. It is also submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Mahalgaon P.S. Case No. 110 of 2025, subject to the conditions

7. One of the bailors of the petitioner shall be his father, namely, Ajit Kumar Mandal.

8. However, if the investigating officer of the case files an application before the learned trial court bringing to its notice that petitioner despite giving assurance to this Court is not cooperating in the investigation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
