JUSTICE BIRENDRA KUMAR ORAL ORDER 28-09-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341,323,324,307,504 and 34 of the Indian Penal Code. Submission is that land dispute between the parties is reason behind the occurrence of abuse and assault. There is case and counter case. Parties have entered into a compromise.

Considering the fact that the petitioners had caused injury at the abdomen of the informant with Chaku, which was found to be simple in nature, I am not inclined to enlarge the petitioners on anticipatory bail in

Patna High Court Cr.Misc. No.34345 of 2018 (5) dt.28-09-2018 2/2 connection with Punpun P.S.Case No.83 of 2018 pending in the court of learned Sub-Divisional Judicial Magistrate, Masaurhi.

Hence, prayer is refused.

In the event of surrender of the petitioners within three weeks, their prayer for regular bail shall be considered without being prejudiced by this order. (Birendra Kumar, J) Nitesh/- U T
