The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 385, 386, 387, 379, 504, 506 of the Indian Penal Code of the IPC and Section 27 of Arms Act.
As per prosecution case, the petitioner and his associates reached at the house of informant and assaulted him. It is further alleged that they also demanded Rs. 50,000/- as ransom on pistol point.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. There is no specific allegation of assault as well as demand of extortion against this

Moreover, similarly situated co-accused namely, Umesh Singh has already been granted bail by a co-ordinate Bench of this Court vide order 29.6.2022 passed in Cr. Misc. No. 12573 of 2022. It is further submitted that the petitioner is languishing in judicial custody since 18.12.2021. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chausa P.S. Case No. 230 of 2016 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Udakhunganj, Madhepura.
