The present petition is by way of second attempt at the behest of the petitioner for grant of regular bail in connection with Sessions Trial No. 696 of 2022, arising out of Laxmipur P.S. Case No. 131 of 2021, registered for the offences punishable under Sections 395, 397 and 412 of the Indian Penal Code, inasmuch as the prayer of the petitioner for grant of regular bail was rejected earlier by this Court, by an order dated 05.05.2022, passed in Criminal Miscellaneous No. 67884 of 2021.

The allegation is regarding six unknown miscreants, whose faces were covered, having intercepted the informant and his companion and thereafter they are alleged to have committed loot and snatched a motorcycle, a laptop, two mobile phones, cash amounting to a sum of Rs. 70,600/- and gold ornaments etc.

The learned counsel for the petitioner has submitted that the petitioner is languishing in custody since 11.08.2021, the charges have already been framed and as far as the other three criminal cases, in which the petitioner is an accused, are concerned, he has already been granted bail. It is further submitted that no Test Identification Parade has taken place so as to connect the petitioner with the alleged crime. 5.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the materials

Patna High Court CR. MISC. No.74308 of 2023(2) dt.08-12-2023 3/3 available on record, as also considering the period of incarceration of the petitioner and the fact that charges have already stood framed, I deem it fit and proper to admit the petitioner to the privilege of regular bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II, Jamui in connection with Sessions Trial No. 696 of 2022 arising out of Laxmipur P.S. Case No. 131 of 2021.
