2. Appellant and Respondent No. 11 - Dharmendra

Patna High Court L.P.A No.1069 of 2024(2) dt.10-09-2025 2/2 Kumar Sharma were colleagues in the Education Department while affecting inter transfer. There were certain issues relating to handing over the charge of the post. Appellant alleges that Respondent No. 11 during the transit of transfer and taking over the charge or handing over the charge he has alleged to have misappropriated certain amount of money. On such allegation, he was placed under suspension and it was not concluded initiating departmental inquiry and its logic end. Hence, appellant is aggrieved by the inaction on the part of the official respondent and preferred CWJC No. 13594 of 2024. The appellant has no locus, for the reasons that by virtue of any action of the 11th Respondent, appellant's service condition has not been affected in any manner. Therefore, the appellant has not made out a case so as to interfere with the order of learned Single Judge dated 10.09.2024 passed in CWJC No. 13594 of 2024.

3. Accordingly, LPA No. 1069 of 2024 stands dismissed.
