2. The petitioner is in custody in connection with Lakhura P.S Case No. 107 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 109(2), 76, 303(2), 352, 351(3), 3(5) and 103 of BNS.

3. As per prosecution case, petitioner along with co-accused have assaulted the informant and his family members.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that earlier prayer for regular bail of the

Patna High Court CR. MISC. No.74505 of 2025(3) dt.21-01-2026 2/3 petitioner was rejected by the Co-ordinate Bench of this court in Cr. Misc. No. 85332 of 2024. It is further submitted that petitioner has got no criminal antecedent as stated in paragraph no. 3 of the bail petition. It is also submitted that petitioner is in judicial custody since 08.09.2024.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that this is a second attempt for regular of the petitioner, earlier prayer for regular bail of the petitioner was rejected by the Co-ordinate Bench of this court in Cr. Misc. No. 85332 of 2024. Petitioner is under custody since 08.09.2024. Only one injury caused by petitioner by lathi on the injured.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran in connection with Lakhura P.S Case No. 107 of 2024, subject to the

Patna High Court CR. MISC. No.74505 of 2025(3) dt.21-01-2026 3/3 condition that petitioner shall furnish the bail bond after framing of the charge.
