The petitioner has prayed for bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

As per allegation in the FIR, while brother of the informant was returning from Hajipur Railway Station, 3-4 accused persons surrounded him and opened fire and during course of treatment at PMCH, Patna, he died.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. The alleged occurrence took place due to land dispute and dirty village politics. Petitioner is not named in the FIR. On the basis of self-confessional statement, name of the petitioner came into

During investigation, no substantial evidence has been found against the petitioner to show his involvement in the present case. No one is eye witness of the alleged occurrence. Petitioner is languishing in judicial custody since 17.01.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 967 of 2021.
