Petitioners apprehend their arrest in connection with Sadar P.S.Case No. 200 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 337, 338, 307 and 302 of the Indian Penal Code.
Petitioners are not named in the FIR and later on their names transpired in the confessional statement of co-accused. Submission of learned counsel for the petitioners is that except confessional statement there is absolutely nothing against the petitioners and similarly situated co-accused have been granted privilege of anticipatory bail by this Court vide order dated 27.7.2018 passed in Cr.Misc.No. 39976 of 2018 and vide order
Patna High Court Cr.Misc. No.40072 of 2018 (3) dt.08-08-2018 2/2 dated 16.5.2018 passed in Cr.Misc.No. 29984 of 2018. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Sadar P.S.Case No. 200 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
