The petitioner apprehends her arrest in connection with Amour P.S. Case no. 114 of 2015, registered under Sections 364 and 120(B) of the Indian Penal Code. The accusation is that Abdul Wahid, son of complainant/O.P. No.2 Mursheed Alam, who used to reside at Delhi was called on phone by his maternal aunt Bibi Raisa Khatoon that she has been left at railway station on 23.03.2015 and asked him to accompany her. Thereafter, Abdul Wahid went at Delhi railway station and accompanied his maternal aunt Bibi Raisa Khatoon at his resident and also informed to
Patna High Court CR. MISC. No.67568 of 2019(2) dt.15-11-2019 2/3 Md. Mustaq brother of Bibi Raisa Khatoon. Thereafter, Md. Mustaq came at the house of son of complainant/O.P. No.2 and made request to come with them at Barbatta. On 05.04.2015 son of the complainant/O.P. No.2 came at Barbatta. When complainant/O.P. No.2 talked on mobile on 06.04.2015 to Md. Mustaq regarding his son then they replied that his son has proceeded for his house, but Abdul Wahid, son of the complainant/O.P. No.2 did not return to the house. Learned counsel for the petitioner submits that, in fact, the son of the complainant/O.P. No.2 moved anywhere without giving any information to the complainant/O.P. No.2,but he lodged the present case mere on suspicion. Further submission is that similarly situated co-accused Mustaque @ Md. Mustaque and three others have already been granted prearrest bail by a co-ordinate Bench of this Court on 08.03.2019 vide Criminal Miscellaneous No. 3830 of 2019. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like
