2. Petitioner seeks regular bail in connection with Laukahi P. S. Case No. 182 of 2023 in a case registered for the offence punishable under Sections 302, 201 and 120(B) of the Indian Penal Code.
3. As per the prosecution case, Jitni Devi, wife of the deceased is the informant. She alleged that her husband who was a driver in Delhi was in love with Nilam Devi who is wife of Vijay Yadav. Nilam Devi solemnized her second marriage with the deceased and started residing with him in Delhi. Some alteration took place between Nilam Devi and the deceased. Thereafter, she hatched conspiracy with her first husband, Vijay Yadav to kill the deceased. Thereafter, at the request of Nilam Devi, the deceased came to the house of co-accused Vijay Yadav
Patna High Court CR. MISC. No.72650 of 2025(2) dt.04-11-2025 2/2 where they committed his murder.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. As a matter of fact, the informant herself committed murder of her husband and concealed the dead body in the house of the co-accused persons. Similarly situated other coaccused person, namely, Vijay Yadav has already been granted regular bail by a co-ordinate Bench of this Court vide order dated 11.07.2024 passed in Cr. Misc. No. 25055 of 2024. Petitioner is in custody since 14.04.2025.
5. Learned counsel for the informant opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-III, Jhankarpur, District- Madhubani in connection with Laukahi P.
