The petitioner apprehends his arrest in connection with Tillouthu P.S. Case no. 108 of 2018, registered under Section 30(a) and 36 of the Bihar Prohibition of Excise Act. The accusation is that on receiving secret information about keeping the liquor in boaring room situated in village-Dhawdar by Jaleshwar Singh, Kuldeep Singh, Madan Gour, Ravi Singh and Nandu Singh. The informant along with other Police personnel reached there. On seeing the Police party some persons started fleeing, while they were chased, but they succeeded to flee away taking advantage of darkness. On search of boarding room, 310 packets each containing 48 bottles of 180 ML, 12 packets, each containing 48 bottles of

Patna High Court CR. MISC. No.66033 of 2019(2) dt.05-11-2019 2/2 180 ML and 02 packets each containing 24 bottles of 375 ML Indian made foreign liquor recovered.

Learned counsel for the petitioner submits that petitioner was not apprehended on the spot. The petitioner is not the resident of P.O village. The petitioner has falsely been implicated in this case mere on suspicion.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.-II-cum-Special Judge, Excise in connection with Tillautho P.S. Case No. 108 of 2018, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
