====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1) and 3(5) of the B.N.S., 2023.
3. As per the fardbeyan of Vinoda Devi, in brief, her sister-in-law Janki Devi was married about twelve years ago to Rajdev Pandit. It is alleged that the deceased was not living peacefully at her matrimonial home and was subjected to cruelty and assault. On 08.06.2025, her husband Rajdev Pandit and brother-in-law Niranjan Pandit allegedly assaulted her mercilessly, as a result of which Janki Devi died.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.72084 of 2025(3) dt.01-12-2025 2/2 informant is not an eye-witness to the occurrence. The petitioner is the devar of the deceased. It is further submitted that the F.I.R. stands contradicted by the post-mortem report, as no external injury was found on the person of the deceased. The petitioner is in custody since 10.06.2025 and claims clean antecedents.
5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail.
6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jhanjharpur, Madhubani, in connection with Andhramath P.S. Case No. 102 of 2025 corresponding to G.R. No. 1080 of 2025. (Prabhat Kumar Singh, J) Neha/- U T
