JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2018 The petitioner is apprehending his arrest in connection with Turkaulia (Banjaria) P.S. Case No. 528 of 2017, registered for offences punishable under Sections 363 and 365/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of 2 1⁄2 years son of the informant.

Submission of learned counsel for the petitioner is that only on the disclosure made by one person, the name of the petitioner has transpired in this case and at that time that witness was in custody.

Heard learned A.P.P. as well as learned counsel for the informant also, they have drawn attention towards paragraph 14 of the case diary, that shows hands of petitioner and the boy is still

Having heard both sides, considering the facts and circumstances of the case as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, this application is dismissed.
